The Can Collect, no more bins lingering in the street, again!

RESIDENTIAL TRASH CAN VALET SERVICE AGREEMENT

 This Service Agreement (“Agreement”) is entered into between The Can Collect (“Service Provider”) and [You] (“Customer”).

1. SERVICES PROVIDED

The Can Collect agrees to provide residential trash can valet (can to curb and return) services, which include:

  • Moving Customer’s designated trash and/or recycling bins from the residence to the curb on scheduled municipal collection days

  • Returning bins to the designated location after collection

 Services are limited to standard, city-approved trash and recycling containers only.

2. SERVICE SCHEDULE

  • Service will be performed on the Customer’s scheduled city trash collection day(s)

  • Bins will be moved the evening before or the morning of pickup and returned the same day after collection, weather and access permitting

  • Holidays, route changes, or city delays may affect service

 

3. CUSTOMER RESPONSIBILITIES

Customer agrees to:

  • Ensure bins are accessible and not blocked by vehicles, gates, debris, or construction

  • Properly bag and tie trash

  • Comply with city waste regulations

  • Secure pets during service hours, 5:00pm-9:00pm CST

  • Maintain bins in a reasonably sanitary condition

The Can Collect is not responsible for missed service due to blocked access, improper preparation, or unsanitary conditions.

4. FEES & PAYMENT

  • Monthly service fee: $34.95 per month (includes up to 2 standard city-approved trash or recycling containers)

  • Additional containers: $5.00 per container per month, no more than 4 cans.

  • Payments are billed in advance and placed on automatic billing, monthly.

  • Late or failed payments may result in suspension of service

 No refunds will be issued for missed service due to weather, city delays, access issues, or health/safety concerns.

5. UNSANITARY CONDITIONS & MAGGOT CLAUSE

For the safety of our staff:

  • The Can Collect reserves the right to refuse service to any container that presents a health hazard, including but not limited to:

    • Active maggot infestation

    • Excessive loose waste, leaking fluids, or strong odors

    • Presence of biohazardous material

  • If a bin is found to be heavily infested with maggots or otherwise unsafe to handle:

    • Service for that pickup may be skipped without refund

    • Customer will be notified

    • Service will resume once the container has been cleaned and returned to a sanitary condition

  • The Can Collect does not provide pest removal or deep sanitation unless separately contracted. This service is not applicable at this time.

6. PAUSE / CANCELLATION

  • Service may be paused for vacations with 48 hours’ notice

  • Either party may cancel service with 14 days’ written notice

  • No long-term contract required unless otherwise agreed

7. WEATHER & FORCE MAJEURE

Service may be delayed or skipped due to severe weather, unsafe conditions, or events beyond control. No refunds apply. We will notify.

8. DAMAGE & LIABILITY

  • Reasonable care will be taken when handling bins

  • The Can Collect is not responsible for damage to old, cracked, overfilled, or defective containers

  • Liability is limited to the amount paid for the current month of service

  • We carry General Liability Insurance

9. INDEPENDENT CONTRACTOR

The Can Collect is an independent service provider and is not affiliated with the City of Waxahachie or its waste provider.

10. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Texas.

11. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties and may be modified only in writing.
